1. Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services provided by PredictWave, Inc. (“PredictWave,” “we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms.
If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Use of the service
We grant you a limited, non-exclusive, non-transferable right to access and use the platform in accordance with these Terms and any order or subscription you have entered into with us.
You agree not to misuse the services, including by attempting to gain unauthorized access, interfering with normal operation, reverse engineering, or using the services in violation of applicable law.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Customer data
You retain all rights to the data you upload or otherwise provide to the platform (“Customer Data”). You grant us a limited license to process Customer Data solely to provide and improve the services for you.
You are responsible for ensuring you have the necessary rights and permissions to upload and process Customer Data through the platform.
5. Fees and payment
Paid plans are billed according to the pricing and terms set out in your order or subscription. Unless otherwise stated, fees are non-refundable and exclusive of applicable taxes.
6. Intellectual property
The services, including all software, content, and trademarks (excluding Customer Data), are owned by PredictWave or its licensors and are protected by intellectual property laws. These Terms do not grant you any rights other than those expressly stated.
7. Disclaimers
The services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Forecasts, insights, and recommendations generated by the platform are provided for informational purposes and do not constitute professional, financial, or legal advice. You are responsible for decisions made based on the output.
8. Limitation of liability
To the maximum extent permitted by law, PredictWave will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the services.
Our total liability for any claim arising out of these Terms or the services will not exceed the amounts you paid to us in the twelve months preceding the event giving rise to the claim.
9. Termination
You may stop using the services at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the services ends, and we will handle Customer Data as described in our Privacy Policy.
10. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will revise the “last updated” date above and, where appropriate, provide additional notice. Continued use of the services after changes take effect constitutes acceptance.
